Dzine Furnishing Solutions Limited - conditions of hire

Please read carefully to ensure that these conditions do not contain anything with which you do not agree.

  1. GENERAL

(a) Definitions- This contract is for the hire of items and accessories (“Equipment). The parties to the contract are:

I. The “Hirer” and where the hirer is not and individual acting in person, the “signatory” overleaf.
II. Dzine Furnishing Solutions Limited (Registered No: 04717004) with registered offices at Hereford House Offa Street Hereford HR1 2LL (Dzine).

Any condition deemed invalid would not affect other conditions. Nothing in this contract is intended to limit a customer’s existing legal rights.

(b) Extent of Contract and Cancellation. The contract is not assignable and is effective when Dzine accepts the Hirer’s detailed order. Dzine reserves the right to charge for cancellation.

(c) Termination. Dzine may terminate the contract and repossess equipment without affecting any rights to recover monies due, damages for breach of contract or other remedies where the Hirer is in breach or is involved in insolvency or liquidation proceedings.

(d) Ownership of Equipment and Goods. Equipment hired remains the property of Dzine at all times.

  1. HIRE CHARGES

(a) Basis of charging. The hire prices quoted are for the duration of the exhibition or event for which they are hired, up to a maximum of 2 weeks and exclude VAT, which will be added at the rate ruling at the date of invoice.

(b) Transport Charges. Delivery and Collection including attempted calls are chargeable. For exhibitions in the UK, the company reserves the right to apply a delivery surcharge.

(c) Cancelled Orders, full refund offered if cancelled 14 days prior to delivery.

(d) Time for Payment and VAT. The hirer will pay all monies outstanding, including VAT on demand (interest on amounts is at Lloyds Bank base rate plus 4%) and will be liable for reasonable legal charges incurred by Dzine in the recovery of amounts due, Equipment and/or Goods.

(e) Deposits. Deposits are set by Dzine at amounts reasonably required and will be offset against any monies due. Deposit balances are refunded upon return to Dzine of equipment in good condition. Balances of deposits paid by cheque will be refunded by cheque in within 7 business days.

(f) Loss of Equipment, cleaning and damage repair. Dzine will treat equipment unavailable for inspection after reasonable notice as lost and levy a penalty charge against the Hirer equal to the current replacement value plus original hire charge.

The Hirer will pay for the required cleaning, breakages, and damage repair and/or equipment loss. Hire charges accrue until full settlement is made. Keys not returned at the end of the hire period will be charged to the hirer at £25 per key.

(g) Credit and Debit Card transactions. Where the hirer has signed a bank credit or debit voucher, with a subsequent shortfall, Dzine may insert and present for payment the balance due. Part payments debit card may also be processed by Dzine at interim stages of the contract.

(h) Complaints. Complaints should be submitted in writing during the open period of the event or exhibition. This will ensure that they are fully investigated on site.

  1. HIRER’S REPSPONSIBILITIES

(a) Inspection and receipt of Equipment and Goods. The Hirer will sign to acknowledge receipt at delivery/hand over. Shortages must be agreed and noted on the contract/delivery document. Equipment defects should be reported to Dzine as soon as possible.

(b) Delivery/Collection of Equipment and Goods. The Hirer will provide adequate delivery and collection access. Equipment transported in the Hirer’s own vehicle will be at the Hirer’s risk.

(c) Security of Equipment. The Hirer accepts responsibility for Equipment security until its collection by or return to Dzine and undertakes not to sell or relinquish possession, alter, modify, repair it in any way.

(d) Return or Collection of Equipment. The Hirer may arrange for the return or collection of Equipment during normal business hours and when equipment has been returned or collected, Dzine will issue a collection/return note. The Hirer will remain liable for ongoing hire charges until such collection/return note has been issued. The Hirer remains responsible for the equipment until collection. Hirer’s are reminded that all equipment should be emptied of personal belongings at the conclusion of the event ad Dzine accepts no responsibility for their safe keeping.

(e) Lost or Stolen Equipment. The Hirer agrees to insure the equipment on a full replacement basis against the risks of loss and theft and on demand to pay Dzine any insurance claim proceeds. All furniture is to be insured by the client for 4 times the full hire price. This liability is without prejudice to any Dzine rights under the contract. Replacement equipment purchased with insurance claim proceeds is the property of Dzine. Dzine accepts no liability whatsoever for any damage or injury caused by the misuse by the Hirer of Dzine’s property.

  1. DZINE’S RESPONSIBILITIES

(a) Hire Rates. Dzine will maintain the agreed hire rates for the duration of the contract.

(b) Limitation of Liability. The liability of Dzine for claims made by the hirer does not extend to any unforeseeable financial loss caused by late or non-delivery of equipment, unsuitability, stoppage or lawful repossession. Subject to the above, Dzine will be liable for negligence or error in the performance of its obligations under the Contract.
